Fight against terrorism, procedural safeguards, and individuals’ rights: a comparison between Morocco and Spain

The legal systems of Spain and Morocco are quite different, however they are required to cooperate in both the substantive aspects of criminal law (Penal Code) and the procedural aspects (Criminal Procedure Law), in order to combat terrorism effectively. This cooperation requires a minimum degree of policies harmonization between the two countries in this field. Resolutions of the United Nations Security Council can provide a basis for achieving this goal.

A conference by Mohamed Rouin Mazouz, associate professor at Abdelmalek Essaâdi University in Tangier and lecturer at Rey Juan Carlos University in Madrid. In 2020, he obtained his PhD in Criminal Law from the Universidad Autónoma de Madrid with a dissertation comparing the criminal law and criminal procedure frameworks governing terrorism offences in Spain and Morocco. His doctoral thesis was published in 2023 under the title Crímenes terroristas: un enfoque legal y procesal para España y Marruecos. Estudio comparativo (Egregius Ediciones).
