Legal Permeability in Cultural Diversity: New Cases and Some Background Reflections

Law, understood as the set of principles and norms based on the idea of ​​justice that regulates human relations in a society, is a cultural production. And, as such, it is the result of a long historical process undermined by religious, economic or political ideologies, among others.

The settlement in our country of groups of non-European immigrants, of Islamic culture and confession, generates different types of family law conflicts that find their origin in the differentiation and coexistence of cultures. The presentation that concerns us analyzes cases related to family conflicts that are generated as a result of polygynous marriages and the so-called “forced marriages”, where the Islamic religious factor is an added element to the nationality of the spouses.

María Asunción Asín has a doctorate in Law from the Universidad La Laguna. She has specialized in the study of the competences of the Autonomous Community of the Canary Islands in matters of foreigners and immigration, in the analysis of the legal framework of unaccompanied immigrant minors, in the international agreements on migration signed by the Spanish State with African countries and in the right of family reunification. She has also published articles on Islamic law and interculturality.
