EU Relations With Southern Mediterranean Countries: The Democratic Conditionality Clause

Since the ’80s, the European Union (EU) has used its foreign relations as a tool to get other states to commit to structuring its legal-political structure in accordance with the parameters of a democratic system that respects human rights. In this sense, the EU endorses the so-called political discourse of conditionality, which allows an international subject to condition its relations with other subjects with respect to certain values. The most obvious legal manifestation of conditionality is the so-called “democratic clause”. For more than thirty years, the EU has maintained democratic principles and respect for human rights as the main pillars of its external action, including in the various international agreements with countries in the Mediterranean. In order to understand Euro-Mediterranean relations, it is essential to comprehend the design of this “democratic clause” as well as to critically analyze its praxis and consequences.

Maria del Carmen Muñoz Rodríguez is an associate professor at the International Public Law and International Relations department in Jaén University since 1996, as well as the director of the Secretariat of Conventions and Normative Development. She is part of several prestigious organizations such as the Spanish Association of International Law Professors and the European Society of International Law. Among her publications, the book Democracia y derechos humanos en la Acción exterior de la Unión Europea (Editorial Reus, 2011).
